House Bill # 2 - SIGNED BY GOVERNOR ON 5/18
This bill increases the penalties for animal fighting, baiting, and attendance from a class F felony to a class E felony, and increases the penalties for being present where an exhibition of fighting and/or baiting is being prepared and knowing that the exhibition is about to take place from a class G felony to a class F felony. This bill also expands the penalty provisions to allow a court to order persons convicted under ยง 1326 to attend mandatory counseling and/or psychological treatment, and to pay the costs of treatment and/or counseling.
Senate Bill 280 -PASSED HOUSE AND SENATE - TO GOVERNOR TO BECOME LAW
This bill establishes health, adoption, and record keeping requirements for animal shelters operating in Delaware and updates the euthanasia provisions applying to shelters.
Senate Bill 280 was supported by all the animals shelters including: Faithful Friends No Kill Animal Shelter, Delaware Humane Association, Delaware SPCA,Kent County SPCA, Safe Haven Animal Sanctuary. A law that restricts tethering or tying a dog outside during the hours of 11 p.m. to 6 a.m. making it illegal to have your dog live on a lease or chain 24/7. It also restricts day time tethering include 35° or less and 90° or higher temperatures.
